Many entrepreneurs are surprised to discover that litigating the average patent dispute will cost more than $2 million, and that there is more to trademark clearance than simply searching the internet for exact matches. At Hilgers Graben, we have decades of experience, won here and at the country’s top law firms, with every step of the trademark clearance, registration, and enforcement process. We also tackle the complexity of patent litigation by combining battle-tested national trial counsel with world-class discovery counsel, in addition to experienced patent professionals at a price point that makes sense for our clients.

In a newly published Law360 article on Friday’s Supreme Court unanimous ruling on pure omissions pleadings involving the antifraud provisions of the Exchange Act, HG’s GIRE head (and former SEC enforcement attorney) Scott Mascianica warns that the SEC might not escape the impact of the court’s decision. In analyzing the Supreme Court’s opinion, Scott noted he sees the opinion as “absolutely having an impact on the SEC and what it will be required to plead and what I think courts are going to expect going forward."

HG’s own Head of Government Investigations Scott Mascianica was quoted in Agenda’s recent article examining SEC and DOJ scrutiny of independent directors.

Nick Muscavage from Agenda is one of the best in the biz covering board and director issues. Very much enjoyed chatting with him on the topic of #SEC and #DOJ scrutiny of outside directors. #agenda #hilgersgraben https://lnkd.in/g_BHB8EH

Hilgers Graben offers world-class discovery counsel services, so it is fitting that our first international hire, John Natividad, would be the Chief Technology Officer of HG Edge, our eDiscovery service provider, a sister entity to the Firm, created to meet the eDiscovery needs of firm clients. Along with HG Edge co-directors Erika De Leon and David Kang, John has proven adept at making sure that cutting-edge technology doesn’t just work hand-in-hand with Hilgers Graben’s legal team, but hand-in-glove.

At Hilgers Graben, not only do members of our patent litigation team have the necessary forum experience (a proven track record in popular federal courts, the Federal Circuit, and the PTAB), but many of them have technical niche expertise as well. Sue O'Brien, for example, has a research masters in chemistry and biochemistry, which culminated in the analysis of the effect of backbone N-methylation on the cell permeability of small cyclic peptides. While she has excelled at contract litigation and IP work that may seem removed from the laboratory, she is able to draw on her unique perspective and her scientific vocabulary translation skills when it comes to intellectual property disputes related to medical devices, pharmaceuticals, biosimilars, chemicals, and even software.
